is the data controller of your personal data within the meaning of the GDPR and the Code.

Personal data refers to any information related to an identified or identifiable natural person (hereinafter referred to as "Data").

Data provided by you: This includes all the data you have provided to request the purchase and sale of a good and/or the provision of a service. Examples of such Data may include your full name, contact details (including address, phone number, and email), profession, date and place of birth, and tax identification number. Providing this information, if required by the contract or essential for its execution, is a necessary condition for concluding the contract. Failure to provide such data may result in the inability to finalize the contract and/or for ART OF SHINE to provide the related services and products.

ART OF SHINE does not collect or process special categories of personal data, such as information revealing your racial or ethnic origin, political opinions, religious or philosophical beliefs.

3. On What Legal Bases and According to Which Regulations Will We Process Your Data?

Personal data refers to any type of information related to an identified or identifiable natural person (hereinafter referred to as “Data”). We will process your Data exclusively where permitted by applicable legal provisions. Specifically, we will process your Data based on Articles 6 and 9 of the GDPR and on the basis of consent pursuant to Article 7 of the GDPR, as well as in compliance with the corresponding provisions of the Code:

  • Consent (Article 6(1), Paragraph 1(a), Article 7 GDPR): We will process certain Data only with your prior, free, and explicit consent. You have the right to revoke the consent given at any time with effect for the future.
  • Contract Execution: In order to conclude and execute the requested contract, it is necessary to access and process certain Data.
  • Compliance with a Legal Obligation (Article 6(1), Paragraph 1(c) GDPR): To ensure compliance with these regulations, we must process certain Data.

4. For What Purposes Are Your Data Processed?

We will process your Data solely and exclusively for purposes permitted by data protection regulations, such as:
a) Purposes you have previously approved;
b) Processing of data to execute the Contract;
c) Execution of pre-contractual measures at your request;
d) Compliance with legal obligations to which we are subject;
e) Safeguarding our legitimate interests or those of third parties, provided that your interests do not prevail over them;
f) Establishment, exercise, or defense of a legal right or claim;
g) Reasons of significant public interest;
h) Marketing and advertising, particularly direct marketing activities.

Among other things, we will process your data for specific purposes, including but not limited to:

  • Contract-related purposes: Primarily, to execute the Contract you have entered into with us.
  • Contacting you regarding the Contract and managing its execution.
  • Customer service: To provide you with effective customer service, we will regularly process your Data, for example, to offer you comprehensive assistance. Solely for the purpose of improving the quality of customer care processes and staff training, we may process personal data collected through sample call recordings, in compliance with privacy regulations and the guidelines of the Data Protection Authority.
  • Handling legal warranty requests, product compliance, assistance requests, contract withdrawals, and contract resolution.

Processing of Your Data Subject to Consent

In the following cases, we will process your data only if you have given your explicit consent:

i) Market research, possibly based on profiling activities: We conduct market research concerning our customers' interests to offer them relevant and targeted offers. This includes, for example, studies on customer satisfaction with our services. Whenever possible, we process only anonymized and aggregated data for market research activities. However, in some cases, we may also process your personal Data.

ii) Advertising and marketing: If you have previously given your consent, we will process your Data to inform you about any offers that may interest you and will contact you through communication channels you have expressly authorized. Promotional and marketing activities (including participation in contests and prize operations) may be carried out via telephone, SMS, or email. You can object to such processing at any time.

Beyond the above, ART OF SHINE may process your Data to comply with legal obligations, including adhering to any laws or regulations we are required to follow. This includes ensuring the security of your data and our company data against external attacks, preventing fraud, handling legal disputes, and fulfilling mandatory tax, accounting, and administrative obligations in accordance with current regulations.

Finally, ART OF SHINE may process your Data to safeguard its own legitimate interests, provided that your interests do not prevail. This includes sales monitoring to improve the services provided in an aggregated and anonymous manner without revealing your identity, as well as conducting research to enhance our products, services, and operational procedures.

5. For what period will we process your data?

As expressly provided for in Article 5, paragraph 1, letter e) of the GDPR, we will retain your data only for the time necessary to process it for the purposes for which it is processed. If we process the data for multiple purposes, it will be automatically deleted or stored in a format that does not allow any direct conclusion to be drawn about your identity as soon as the last specific purpose has been fulfilled. This ensures that all your data is deleted or anonymized in line with the principle of data minimization and in compliance with Article 5, paragraph 1, letter e) of the GDPR.

Indicatively, your data will be retained for the following periods:
– Tax/administrative obligations: 10 years.

How is your data protected?

ART OF SHINE will process your personal data based on the security obligations related to data processing under Article 32 of the GDPR. To ensure an adequate level of data protection and mitigate the risk of misuse or unlawful use, we have implemented technical and organizational measures that comply with internationally recognized IT standards. These measures are continuously monitored.

With whom will your data be shared?

Your data may be shared with third parties, including:
• Entities within ART OF SHINE and/or partner companies of ART OF SHINE, always adopting appropriate measures to ensure that your data is processed, protected, and transferred in compliance with applicable legal provisions. For example, this may be done to improve IT services, when you have consented to share your data with other group companies for commercial or marketing purposes, for group reporting, for verifying complaints and requests, for managing defects and damages of purchased goods, and for providing additional requested services.
• External third parties where necessary or appropriate to achieve the purposes stated in sections 3 and 4, or in compliance with legal obligations regarding information and reporting. These third parties include external service providers such as IT services, external consultants, or collaborators, in the following contexts:
– Enveloping, sorting, and transmitting communications to customers, as well as data storage and archival;
– Providing and managing administrative procedures and IT systems, communication networks, and security systems;
– Customer assistance activities (including call centers, help desks);
– Auditing, accounting review, and financial certification activities;
– Commercial information services provided by external companies authorized by law, event organization, advertising campaigns, quality assessment of products and services, and market research;
– Professional consulting and assistance activities.

ART OF SHINE will appoint all the above-mentioned entities as Data Processors, where applicable, and will require these third parties to maintain confidentiality regarding your data.

ART OF SHINE commits not to transfer your data outside the European Community.

Your Rights

Under the GDPR and other applicable data protection regulations, you have specific and non-limitable rights.

As a data subject, you have the following rights under the GDPR concerning ART OF SHINE:

Right of access (Art. 15 GDPR): You can request information at any time about the data we hold about you. This includes categories of processed data, processing purposes, data sources (if not directly provided by you), and recipients to whom we may have transferred your data, where applicable. You can receive a free copy of your contractual data.
Right to rectification (Art. 16 GDPR): You can request the correction of your data. We will take appropriate measures to ensure that your data stored and continuously processed is accurate, complete, up-to-date, and relevant based on the latest information provided by you.
Right to erasure (Art. 17 GDPR): You can request the deletion of your data if the legal conditions are met. For example, under Article 17 of the GDPR, this could occur if:
• The data is no longer necessary for the purposes for which it was collected or otherwise processed;
• You withdraw consent on which the data processing is based, and there is no other legal basis for the processing;
• You object to the processing, and there are no overriding legitimate grounds for processing, or you object to the processing of data for direct marketing purposes;
• The data has been unlawfully processed;
• However, data processing is necessary for:
– Compliance with a legal obligation requiring the processing of your data, particularly regarding legally mandated document retention periods;
– Establishing, exercising, or defending a legal claim.
Right to restriction of processing (Art. 18 GDPR): You may obtain a restriction on processing your data if it is inaccurate or no longer necessary.
Right to data portability (Art. 20 GDPR): You have the right to receive a copy of your data that you previously provided directly to ART OF SHINE, and if expressly requested, we will transfer it—where technically feasible—to another data controller you designate.
Right to object (Art. 21 GDPR): You may object at any time, for reasons related to your particular situation, to the processing of your data under Article 6, paragraph 1, letters e) or f) of the GDPR, or when personal data is processed for direct marketing purposes. In such cases, we will no longer process your data. This does not apply if we can demonstrate compelling legitimate grounds for processing that override your interests or if we need your data to establish, exercise, or defend a legal claim.
Right to withdraw consent at any time (Art. 13 GDPR): If processing is based on consent, you may withdraw it at any time without affecting the lawfulness of processing based on consent before withdrawal. ART OF SHINE will strive to process all requests within a reasonable period, typically within 30 days, unless an extension is justified and communicated.

Complaint: You have the right to report and lodge a complaint with a competent data protection authority under Article 77 of the GDPR.
